1. Introduction

Welcome to Rosterhunter! By accessing or using our website and services, you agree to comply with these Terms of Service. If you do not agree to these terms, you may not use our platform.

2. Eligibility

Our services are intended for users located in the United States and are available to individuals aged 13 years or older. By using our platform, you confirm that you meet this age requirement.

3. User Conduct

You agree to use Rosterhunter in a lawful manner and not to:

• Engage in any activity that violates applicable laws or regulations.
• Attempt to gain unauthorized access to our systems or interfere with the proper functioning of our platform.
• Use the platform to distribute spam, malware, or other harmful content.

4. Subscriptions and Payments

Rosterhunter offers subscription plans with premium features:

Player/Individual Premium Plans

• Monthly Plan: $19.99 per month
• Quarterly Plan: $16.66 per month ($49.99 billed every 3 months) - Save 15%
• Annual Plan: $12.50 per month ($149.99 billed yearly) - Save 35%

Agency Subscription Plans

• Starter Plan: $49 per month or $470 per year (Save 20%)
• Growth Plan: $99 per month or $950 per year (Save 20%)
• Pro Plan: $199 per month or $1,910 per year (Save 20%)

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle (monthly, quarterly, or annually) unless canceled before the renewal date. You will be charged the then-current subscription fee.

Cancellation: You may cancel your subscription at any time through your account settings. Your access to premium features will continue until the end of your current billing period. No refunds will be provided for unused subscription periods, except as required by law.

Price Changes: We reserve the right to modify subscription prices. We will notify you of any price changes at least 30 days in advance. Continued use of the service after the price change constitutes acceptance of the new price.

Failed Payments: If a payment fails, we may suspend or terminate your subscription. We will attempt to notify you of failed payments and provide an opportunity to update your payment method.

5. Referral Program

Rosterhunter offers a referral program to reward users who invite new members to the platform.
- Any registered user may share their unique referral link.
- When a new user signs up through a referral link and starts their free 7‑day Premium trial, both the referring user and the new user are eligible to receive 1 month of Premium access at no cost.
- Referral rewards are granted once the referred user has successfully created an account and begun their free trial.
- Self-referrals, duplicate accounts, or fraudulent activity are strictly prohibited and may result in disqualification from the program and/or account termination.
- Rosterhunter reserves the right to modify, suspend, or terminate the referral program at any time.

6. Account Termination

Termination by You

You may terminate your account at any time by contacting us at info@rosterhunter.com or through your account settings. Upon termination:

• Your access to the platform will be revoked immediately
• Your subscription will be canceled (no refunds for unused periods)
• Your data will be deleted in accordance with our Privacy Policy

Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms of Service
• Engage in fraudulent, abusive, or illegal activities
• Infringe upon the rights of others
• Attempt to gain unauthorized access to our systems
• Use the platform in a manner that harms the platform or its users
• Fail to pay subscription fees when due

Upon termination by us, your access to the platform will be revoked immediately, and no refunds will be provided. We may also pursue legal action if necessary.

Effect of Termination

Upon termination, all rights granted to you under these Terms will cease immediately. Sections that by their nature should survive termination (including but not limited to intellectual property rights, disclaimers, limitations of liability, and dispute resolution) will survive.

7. Intellectual Property

Our Intellectual Property

All content, trademarks, logos, designs, text, graphics, images, software, and other materials on Rosterhunter (collectively, "Content") are the property of Rosterhunter or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, sell, or create derivative works from our Content
• Use our trademarks, logos, or brand names without our prior written consent
• Reverse engineer, decompile, or disassemble any software or technology
• Remove any copyright, trademark, or other proprietary notices

Your Content

You retain ownership of any content you submit, post, or display on Rosterhunter (including profile information, photos, videos, and other materials). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content for the purpose of operating and promoting Rosterhunter.

You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights or applicable laws.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROSTERHUNTER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION ON THE PLATFORM

We do not guarantee that:

• The platform will meet your requirements or expectations
• The platform will be available at all times or without interruption
• Any errors or defects will be corrected
• The platform is free of viruses or other harmful components

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROSTERHUNTER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE PLATFORM
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES RESULTING FROM THIRD-PARTY CONDUCT OR CONTENT ON THE PLATFORM

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you.

10. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@rosterhunter.com. We will try to resolve the dispute within 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, you and Rosterhunter agree to resolve any claims through binding arbitration rather than in court, except for:

• Small claims court cases
• Intellectual property disputes
• Claims seeking injunctive relief

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Jacksonville, Florida, USA.

Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action, consolidated action, or representative proceeding.

11. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to registered users (for significant changes)
• Displaying a notice on our platform (for major changes)

Your continued use of our platform after such changes constitutes your acceptance of the updated terms. If you do not agree with the changes, you must stop using the platform and may terminate your account.

12. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles.

Except for disputes subject to arbitration (as described above), any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Duval County, Florida, USA, and you consent to the jurisdiction of such courts.

13. Data Collection and Tracking

By using Rosterhunter, you acknowledge and consent to our use of tracking technologies, including but not limited to cookies, pixels, and server-side tracking APIs, as described in our Privacy Policy. This includes:

• Client-side tracking via Meta Pixel and other analytics tools
• Server-side tracking via Meta Conversions API and other APIs
• Collection of both attributed events (with user identifiers) and unattributed events (without user identifiers)
• Sharing of hashed personal information (email, phone, name, date of birth, location) and non-hashed identifiers (external ID, Facebook Login ID, click ID, browser ID) with third-party advertising and analytics partners
• Collection and sharing of technical data (IP address, user agent, event metadata) for all events to improve measurement accuracy

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rosterhunter regarding the use of the platform.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet failures.
